Agreement to these terms

These terms are a binding agreement between you and Driving Forever Limited, a company registered in New Zealand ("Driving Forever", "we", "us", "our"). They cover your use of the website at drivingforever.com, the DF Garage mobile app, and any related services we operate under the Driving Forever brand.

By creating an account, placing an order, subscribing to DF Pro, or otherwise using our services, you agree to these terms. If you do not agree, don't use the services.

Eligibility

You must be at least 13 years old to use Driving Forever. If you are between 13 and the age of majority in your country, you may only use the services with permission from a parent or legal guardian who agrees to these terms on your behalf.

You must have the legal capacity to enter into a contract. You are responsible for making sure your use of the services is legal where you live.

Your account

You're responsible for everything that happens on your account. Keep your password private, use a strong and unique one, and tell us quickly if you think someone else has accessed your account.

One account per person. Do not share accounts, sell them, or transfer them.

You agree to provide accurate information when you sign up and to keep it up to date.

Your content

You keep ownership of the content you create or upload (vehicle photos, descriptions, taglines, reflections, journal entries, cards, listings, messages, reviews). We don't claim any of it as ours.

By posting content through our services, you grant Driving Forever a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and adapt that content to the extent needed to run the services — for example, to show your published vehicle card to anyone with the card's link, deliver messages to their recipients, or generate thumbnails.

This licence ends when you delete the content or your account, except where we need to keep it to meet a legal obligation or resolve a dispute.

You warrant that you have the rights to post what you post — including rights to any photos of vehicles or people. If someone else owns an image, get their permission before uploading it.

Acceptable use

When using our services, you agree not to:

  • Post content that is illegal, defamatory, obscene, threatening, abusive, hateful, or discriminatory.
  • Harass, stalk, intimidate, or impersonate other members.
  • Misrepresent your identity, affiliation, or credentials — including posing as staff or an official account.
  • Spam, scam, advertise unsolicited services, or run multi-level or pyramid schemes.
  • Post misleading information in vehicle listings, particularly about condition, ownership, or pricing.
  • Attempt to access anyone else's account or data.
  • Probe, scan, or test the vulnerability of our systems without prior written permission.
  • Reverse engineer, decompile, or try to extract the source code of our apps, except to the extent that law specifically permits.
  • Scrape, bulk-download, or automate access to the services without our written permission.
  • Use the services to build a competing product or to train machine-learning models.
  • Bypass rate limits, paywalls, or moderation systems.

Moderation, suspension, and termination

We may review, moderate, remove, or hide content that breaches these terms or that our moderation systems flag as high risk. We can suspend or close any account that breaks these terms, especially repeat or serious breaches.

We'll try to give you notice where we reasonably can, but we may act without notice where content is harmful, unlawful, or poses a risk to other members.

You can close your own account at any time from the DF Garage app Settings screen, or by emailing us. Closing your account removes your data from our live systems within 30 days (see the Privacy Policy for details).

DF Pro subscriptions

DF Pro is a paid subscription that unlocks features described on our website and in the app. Current pricing is shown at the time of purchase. We may change pricing for future billing periods; if we do, we'll tell you before the change takes effect and give you a chance to cancel.

Subscriptions purchased through the Apple App Store or Google Play are billed by Apple or Google under their own terms. To cancel, manage, or request a refund, use the subscription controls in your App Store or Google Play account. Deleting the app alone does not cancel your subscription.

Subscriptions auto-renew unless you cancel before the next renewal date. You keep access to Pro features until the end of the period you've paid for.

Merchandise purchases

When you buy merchandise from drivingforever.com, the contract of sale is between you and Driving Forever Limited. Stock availability, pricing, and delivery estimates shown at checkout are subject to change until your order is accepted.

Our refund policy and shipping policy form part of these terms.

New Zealand consumers have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these terms limits those rights where they apply.

Member-to-member listings and cards

The DF Garage app lets members publish trading cards and for-sale listings for their vehicles and interact with other members. When you use these features, you understand that:

  • Driving Forever is not party to any transaction between members. We do not verify the accuracy of listings, the condition of vehicles, or the identity of either party.
  • You are solely responsible for any transaction, including inspecting the vehicle, arranging payment, and complying with any registration, warrant-of-fitness, or tax obligations.
  • You should treat listings with the same scepticism as any private sale. Meet in public places for inspections, verify ownership, and never send money based on a listing alone.
  • If you're the seller, you're responsible for providing accurate information, complying with consumer-protection law where it applies to you, and handling any warranty obligations.

We may remove listings that appear fraudulent, misleading, or unsafe, but we have no obligation to monitor or police listings, and our removing or failing to remove a listing is not a warranty about the listing, the vehicle, or the seller.

Vehicle information is not professional advice

The DF Garage app helps you keep track of your vehicles. It's a logbook, not a mechanic, not a lawyer, and not an insurance agent. Maintenance reminders (WoF, CoF, rego, RUC, service intervals), expense tracking, and any figures shown in the app are informational only. You remain responsible for complying with legal and safety obligations for every vehicle you own, and for confirming important details with a qualified professional when it matters.

Our intellectual property

The Driving Forever name, the DF Garage name, the "Different Roads. Same Drive." tagline, our logos, our site copy, our software, and the look and feel of our services are owned by Driving Forever Limited and protected by copyright, trademark, and other intellectual property laws. You may not use them without our written permission, except as allowed by law.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the services for their intended purpose, subject to these terms.

Copyright complaints

If you believe content on our services infringes your copyright, email drive@drivingforever.com with: a description of the work, the URL or location of the alleged infringement, your contact details, and a statement that you are the rights holder or authorised to act for them. We will review and act as appropriate.

No warranties, to the extent allowed by law

The services are provided "as is" and "as available". Except for any guarantees or rights you have under the Consumer Guarantees Act 1993 or other non-excludable law, we do not warrant that the services will be uninterrupted, error-free, secure, compatible with any particular device, or suitable for any specific purpose.

Keep your own backups of important records. While we take care with your data, digital services fail from time to time, and we can't guarantee recovery in every scenario.

Limitation of liability

To the maximum extent permitted by law, Driving Forever Limited, its directors, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive loss or damage, or for any loss of profits, revenue, data, or goodwill, arising from your use of the services.

Our total liability to you for any claim connected with the services is capped at the amount you paid us in the 12 months before the event giving rise to the claim, or NZ$100, whichever is greater.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by our negligence, for fraud, or under the Consumer Guarantees Act 1993 where it applies to you as a consumer.

Indemnity

You agree to indemnify Driving Forever Limited against loss, damage, and reasonable legal costs we suffer because of your breach of these terms, your misuse of the services, or content you post that infringes another person's rights. We'll let you know promptly if a claim arises and you can participate in its defence.

Third-party services and links

The services may link to, or integrate with, third-party services (for example, Apple App Store, Google Play, Firebase, Shopify, payment providers). We are not responsible for third-party services and your use of them is governed by their terms.

Changes to the services and to these terms

We may change, add to, or remove features of the services at any time. We may also update these terms. If we make material changes, we'll tell you by email or an in-app notice and update the "Last updated" date. Continuing to use the services after an update means you accept the new terms. If you don't accept them, stop using the services and, if you want, close your account.

Governing law and disputes

These terms are governed by the laws of New Zealand. The courts of New Zealand have exclusive jurisdiction over any dispute arising out of the services, except that we may bring proceedings to protect our intellectual property in any jurisdiction.

Before going to court, please email us so we can try to resolve the problem directly. For smaller consumer disputes, the New Zealand Disputes Tribunal may be the most practical forum.

Miscellaneous

  • Assignment: you may not assign these terms without our consent. We may assign them as part of a sale, merger, or corporate restructure.
  • Severability: if any part of these terms is found unenforceable, the rest stays in force.
  • No waiver: our failure to enforce any provision isn't a waiver of our right to enforce it later.
  • Entire agreement: these terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, are the entire agreement between you and us on this subject.
  • Notices: we may send notices to the email address on your account; you may send notices to drive@drivingforever.com.
